These Terms & Conditions (“Terms”) govern any order placed on themodernalchemist.bar. By placing an order you accept these Terms in full. Please read them carefully before ordering. These Terms apply to consumer (B2C) sales in Belgium and are governed by the Belgian Code of Economic Law (Book VI — Market Practices and Consumer Protection).

2. Scope
These Terms apply to all orders placed via our online shop. By ticking the “I accept the Terms & Conditions” box at checkout (or by completing your order), you confirm that you have read, understood and accepted them. We may update these Terms from time to time; the version applicable to your order is the one in force on the date you placed it.
3. Products & prices
All products are described as accurately as possible. Photographs are indicative; vintages, batch numbers and labels may evolve.
Prices are shown in euros (€), inclusive of Belgian VAT at 21 %, and exclusive of delivery costs. Delivery costs are calculated at checkout based on parcel weight and destination, and are clearly shown before you confirm your order.
We reserve the right to change our prices at any time, but products are always invoiced at the price displayed when you placed your order, subject to availability.
4. Legal age — alcohol products
Our shop sells alcoholic beverages. Under Belgian law (Law of 24 January 1977, Art. 6), the sale of alcohol to persons under 18 is strictly prohibited. By placing an order you confirm that you are at least 18 years old.
We may ask for proof of age at the time of delivery or collection. If we cannot verify your age, we reserve the right to cancel the order and refund you minus reasonable handling costs.
5. Ordering process
- You add products to your cart and proceed to checkout.
- You enter your billing and delivery details.
- You select a delivery method (Click & Collect at the bar, or Bpost home delivery).
- You select a payment method and complete payment.
- You receive an order confirmation by email. The contract is formed at this point.
We reserve the right to refuse or cancel an order in cases of: stock unavailability, suspected fraud, an obvious pricing error, a non-deliverable address, or where you cannot confirm being of legal age.
6. Payment
Payments are processed by Mollie B.V. (Netherlands) via secure encrypted connection. We accept the methods displayed at checkout (Bancontact, credit cards, etc.). We never store your card details — Mollie handles the entire payment flow.
Your order is dispatched only after full payment has been received and confirmed.
7. Delivery
Click & Collect at the bar — free
Pick up your order at our address (55 avenue Adolphe Demeur, 1060 Saint-Gilles, Bruxelles), during bar opening hours. You’ll receive an email when your order is ready. Bring an ID for age verification.
Home delivery via Bpost — Belgium only
Our standard shipping rate is €12 within Belgium. This rate may evolve as we refine pricing per parcel weight; the exact amount is always shown at checkout before you confirm.
Delivery times are typically 2 to 5 working days after payment confirmation. These times are indicative and not contractual. We will inform you if a significant delay occurs.
We currently ship only to Belgium. International shipping may be added in the future.
If a parcel is returned to us because of an incorrect address or failed pickup, we will contact you to arrange a new delivery at your expense.
Risk transfer
The risk of loss or damage transfers to you when you (or a person you designate) take physical possession of the goods.
8. Right of withdrawal — 14 days
You have the right to withdraw from your order within 14 days of receiving the goods, without giving any reason, in accordance with Article VI.47 of the Belgian Code of Economic Law.
Conditions
Because we sell food/beverage products, the withdrawal right applies only if the bottle is returned intact, unopened, and with its original tamper seal undamaged. This restriction stems from Article VI.53, 4° of the Code (sealed goods that cannot be returned for health or hygiene reasons once unsealed).
A bottle with a broken seal, removed cap, or otherwise opened is excluded from the right of withdrawal — for hygiene and food safety reasons.
How to exercise it
- Email us at enjoycocktails@themodernalchemist.bar within 14 days of receiving your order, stating your wish to withdraw and your order number.
- Send the goods back to us, at your expense, within 14 days of notifying us. We recommend a tracked shipping service — risk of loss during return is on you until we receive the parcel.
- Return address: 55 avenue Adolphe Demeur, 1060 Saint-Gilles, Bruxelles, Belgium.
Refund
We will refund the full price of the eligible (sealed) products and the standard delivery cost within 14 days of receiving the returned goods (or of you providing proof of return, whichever is earlier), via the same payment method you used. Return shipping is at your charge.
9. Legal warranty
You benefit from the 2-year legal warranty of conformity under Articles 1649bis et seq. of the Belgian Civil Code for any product that is defective or does not match the description.
This warranty does not apply to: changes in taste due to incorrect storage by the buyer, normal aging of products with limited shelf life, or damage caused by inappropriate use.

10. Liability
We engage only an obligation of means with respect to delivery times (which are indicative, not contractual). Our liability is limited to the value of the products ordered, except in cases of intentional fault, gross negligence or personal injury — situations in which Belgian mandatory law applies.
We are not liable for indirect or consequential damages (loss of profit, loss of opportunity, etc.).
11. Force majeure
Neither party is liable for failure to perform under these Terms when caused by an event beyond their reasonable control (natural disaster, strike, fire, pandemic, war, transport disruption, etc.). The affected party will notify the other promptly and the obligations are suspended for the duration of the event.
12. Personal data
We process your personal data in accordance with our Privacy Policy, which forms an integral part of these Terms.
13. Intellectual property
All content on this website (logo, photos, copy, layout, product descriptions, etc.) is the property of The Artefact SRL or licensed to it. Reproduction, modification or commercial use without prior written authorisation is prohibited.
14. Complaints
For any complaint, contact us first at enjoycocktails@themodernalchemist.bar — we’ll do our best to resolve it amicably.

15. Applicable law & jurisdiction
These Terms are governed by Belgian law. Any dispute relating to the formation, performance or interpretation of these Terms falls under the exclusive jurisdiction of the French-speaking courts of Brussels (tribunaux francophones de Bruxelles), notwithstanding any mandatory consumer-protection rules giving you the right to bring an action before the court of your place of residence.
16. Severability
If any clause of these Terms is held invalid or unenforceable, the remaining clauses remain in full force. The invalid clause shall be replaced by a valid one reflecting as closely as possible the original economic intent.
